4. SMS/MMS Data Handling
4.1 Message Storage
Messages sent and received through HailMate are stored securely on our servers to provide message history and continuity of service. Messages are encrypted in transit and at rest.
4.2 Third-Party Service Providers
We use Twilio and other third-party messaging service providers to facilitate SMS/MMS delivery. These providers have access to phone numbers and message content necessary to deliver messages, but are contractually obligated to protect your data and comply with applicable privacy laws.
4.3 No Third-Party Sharing of Mobile Information
We do not share, sell, or rent mobile phone numbers or SMS/MMS opt-in data with third parties or affiliates for marketing or promotional purposes.
Your mobile phone number and text messaging opt-in information are used exclusively to provide the HailMate service to you and will not be shared with any third parties or affiliates for their direct marketing, advertising, or promotional purposes. This information is only shared with essential service providers (such as Twilio) who are contractually required to use it solely for message delivery on our behalf and are prohibited from using it for their own marketing purposes.
4.4 Message and Data Rates
Message and data rates may apply. Standard text messaging rates from your mobile carrier will apply to all SMS/MMS messages sent and received through HailMate. Message frequency varies based on your account activity and usage of the Service.
4.5 Customer Contact Information
When you add customer contact information to your HailMate account, you represent that you have obtained proper consent from those customers to store their information and communicate with them. You are responsible for maintaining compliance with applicable privacy laws regarding your customers' data.
4.6 SMS/MMS Consent Requirements
We require explicit, affirmative consent before any SMS/MMS messages are sent. Consent must be separate from other terms and must clearly disclose the sender, message types, message frequency (or that it varies), that message and data rates may apply, and how to get help or opt out.
Contractors using HailMate are responsible for collecting and documenting customer consent before messaging. Implied consent is not sufficient for SMS/MMS communications through our platform.
5. Information Sharing and Disclosure
We do not sell your personal information. We do not share your mobile phone number or SMS/MMS opt-in data with third parties or affiliates for marketing or promotional purposes.
We may share your information (excluding mobile phone numbers and SMS opt-in data, which are protected as described in Section 4.3) only in the following circumstances:
- Service Providers: With third-party service providers who perform services on our behalf (e.g., payment processing, SMS delivery, cloud hosting). SMS delivery providers like Twilio are authorized only to transmit messages on our behalf and are contractually prohibited from using your mobile information for their own purposes
- Legal Requirements: When required by law, court order, or government regulation
- Business Transfers: In connection with a merger, acquisition, or sale of assets
- With Your Consent: When you explicitly authorize us to share your information
